Ramset Reloaded – Terms and Conditions

(“PROMOTIONAL OFFER”) TERMS AND CONDITIONS – AUSTRALIA 

Information on how to enter the promotion forms part of these Terms and Conditions. Individuals who participate in this promotion agree to these Terms and Conditions.

The promotion commences at this Participating Store at 6:00 am AEST on 1st May 2025 and closes at 11:59 pm AEST on 30th June 2025 (“Promotional Period”).

3. The Promoter is ITW AUSTRALIA PTY LTD (ACN 004 235 063 / ABN 63004235063).

4. Employees (and their immediate families) of the Promoter, Participating Stores, resellers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. 

5. The Promoter collects personal information (“PI”) of entrants in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://ramset.com.au/privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the eligible entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia. 

6. Participation in the promotion is restricted to Australian residents aged 18 years and over. The promotion is not available in conjunction with commercial tenders or bulk orders. Resellers are not eligible to enter on behalf of 3rd party customers. 

7. “Participating Store” refers to this store that currently displays advertising material for the promotion and is part of the Independent Hardware Group (either Mitre 10, Home Timber & Hardware, Thrifty-Link Hardware or True Value Hardware).

8. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted Qualifying Transaction (defined below) regardless of the amount spent in excess of $100 in a single Qualifying Transaction; and (b) each entry must be submitted separately and in accordance with entry requirements.

9. The Promoter reserves the right, at any time, to verify the validity of each entry and entrant (including an entrant’s identity, age and place of residence). The Promoter reserves the right, in its sole discretion, to disqualify any person who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Further, any contact details provided incorrectly over the Internet or telephone may be deemed by the Promoter as an invalid entry. Errors or omissions will be accepted by the Promoter in its absolute discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

10. To enter the promotion, individuals must complete the following steps at this Participating Store during the Promotional Period:

  • Spend $100* or more in a single transaction on any Ramset™ product at this Participating Store (“Qualifying Transaction”). *$100 threshold refers to the total value (incl. GST) of Ramset™ products purchased in a single transaction. If a staff member does not automatically hand the individual an official entry form after making a qualifying purchase, it is the individual’s responsibility to request one.
  • Participants must then complete the official entry form available at the point of purchase within this Participating Store. All required fields must be completed in full; and then
  • Place the fully completed official entry form in the entry box provided in store.

11. Entrants must retain their a copy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase, the products purchased and their value/s, and that the purchase was made during the promotional period but prior to entry. Sharing receipt / invoice numbers is not allowed. If the Promoter reasonably believes that an entry has been made on this basis, the Promoter will invalidate all entries affected. 

12. Entries must be completed and submitted physically in-store at the time of purchase. Online or email entries will not be accepted.

13. Incomplete, indecipherable or illegible entries will be deemed invalid.

14. Entries must be received by the Promoter during the Promotional Period. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over mobile telephone or internet communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. 

15. The draw will take place at this Participating Store on 3rd July 2025 by no later than 5:00pm AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The prize winner at this Participating Store will be notified by telephone and email within three (3) business days of the draw. The winner will have their name (first initial, surname and postcode) published on the Promoter’s website at www.ramset.com.au/ramsetreloaded no later than 31st July 2025.

16. The first valid entry drawn at this Participating Store will win a ‘Ramset Branded Bar Fridge’ valued at $399.  

17. If the prize remains unclaimed after 30th July 2025, the prize will be deemed forfeit.  

18. A draw for the prize, if unclaimed, may take place at this Participating Store on 4th August 2025 at the same time as the original draw, subject to any directions from a regulatory authority. The winner, if any, will be notified by email and phone within two (2) business days of the draw and their name (first initial, surname and postcode) will be published at www.ramset.com.au/ramsetreloaded no later than 29th August 2025.

19. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

20. The Participating Store will provide the prize to the winner either via store pick up or delivery. If the winner requests to have their prize delivered, they are responsible for ensuring that all prize delivery details provided are correct. The Promoter nor the Participating Store will not be liable for any costs associated with re-delivery of a prize, should the delivery details provided by the winner be incorrect.   Entrants must provide a valid Australian residential address for delivery. The Promoter reserves the right to deem entries invalid if the delivery address falls outside of recognised Australian postal zones.

21. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification subject to the written directions of any regulatory authority. The winner will not be entitled to any additional compensation in the event that the prize has been substituted at equal or greater value. 

22. Subject to the unclaimed prize draw clause, if for any reason the winner does not the prize at/by the time stipulated by the Promoter, then the prize will be forfeited

23. The prize is not transferable or exchangeable and cannot be taken as cash unless otherwise specified. 

24. The total prize pool value at this Participating Store is $399.

25. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 

26. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, weather, site issues, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant or winner; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 

27. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia that are incapable of being excluded (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 

28. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use/taking of the prize.
